The Talmud suggests an alternative explanation of the mishna’s ruling.

This is what the mishna is saying: In a situation where this litigant chooses one court for himself, in accordance with his preference, and that litigant chooses one court for himself that he prefers, both of them must reach a compromise and choose one additional court for themselves. They must agree on the composition of the court that will judge them.
